Topic 1: Sexual Harassment

A male employee complains to his supervisor. The employee is gay.

He says another employee – who is straight – says things whenever the gay employee passes the straight employee’s cubicle. The gay employee says the straight employee makes sexually suggestive remarks to him, like “Nice buns” or “Nice basket.” of “I’d let you ‘do’ me, even if I am straight.” The straight employee shows pictures of handsome men from his sports magazine to the gay employee and says, “I bet you wouldn’t throw him out of bed for eating crackers!” or “I bet you’d like to see his baseballs!”

The gay employee finds this behavior offensive; he is in a long-term relationship and has no interest in the straight employee.  He finds it offensive to have pictures of these handsome athletes shoved in his face along with suggestive comments. The gay employee demands that something be done or he will seek legal advice.

The supervisor shows up at your HR door. He wants answers for the following questions:

1. “Federal law doesn’t protect against anti-gay harassment, does it?  Why or why not?”

2.  “Can he sue under specific state law”?

3.  “Can’t I tell him he has to live with this?” Why or why not?”

You might “skim” this article for help; the ‘twist’ in this hypothetical is that the “straight” employee does not really have any sexual interest in the gay employee.  It doesn’t fit the usual situation (e.g., a male supervisor “hitting on” his female secretary, who fears for her job if she complains to anyone).

Topic 2: Sexual Harassment in Workplace – student role play

Sexual Harassment in the workplace. This is a student role play for sexual harassment scenario.

The facts of the case are that a Coworker 1 came to their Supervisor alleging they were sexually harassed by Coworker 2 in the workplace. When Coworker 2 was asked by the Supervisor about the allegation he/she denied it. Coworker 1 could not submit any corroboration for her/his allegation against Coworker 2. Both Coworkers are excellent workers. This is a classic “he said, she said” allegation.  

Students with the last names starting with Al through Gar will be coworker 1  who has been allegedly sexually harassed in the workplace by coworker 2.  If you are female then your allegation is against a male Coworker 2, and if a male it is against a female Coworker 2.  In your initial submission only discuss your rights as coworker 1. What are the basic rights of Coworker 1 under federal and specific state law [Maryland, Virginia, etc]? As Coworker 1 what would be your course of action to protect yourself?

Students with the last names starting with Har through Mey will be Coworker 2  will be Coworker 2, the one who is alleged to have sexually harassed a coworker 1. In your initial submission only discuss what are the basic rights of Coworker 2 under federal and specific state law [Maryland, Virginia, etc]? As Coworker 2 what would be your course of action to protect yourself? 

Students with the last names starting with Mi through Yo will be the Supervisor of both Coworker 1 and 2 will be the supervisor/employer of both Coworker 1 and 2.   As the Supervisor, what are your courses of action under federal and specific state law [Maryland, Virginia, etc] to protect yourself, the company and each Coworker? 

In other words, a third of the class takes the position of Coworker 1, a third of the class takes the position of Coworker 2 and a third of the class takes the position of Supervisor. Read the instructions above carefully. You are not to discuss all three positions. Just discuss the position indicated by your last name. DO NOT respond in your initial comments to all three positions.

Your substantive responses must be to two students who have a different role than you had. In other words coworker, 1 will respond to Coworker 2 and or Supervisor comments, Coworker 2 will respond to either Coworker 1 or Supervisor comments and Supervisor will respond to either Coworker 1 and or 2 comments.
